images/news/mafiaa.jpgIn an unusual case in which an Arizona recipient of an RIAA letter has fought back in court rather than write a check to avoid hefty legal fees, the industry is taking its argument against music sharing one step further: In legal documents in its federal case against Jeffrey Howell, a Scottsdale, Ariz., man who kept a collection of about 2,000 music recordings on his personal computer, the industry maintains that it is illegal for someone who has legally purchased a CD to transfer that music into his computer.

The industry's lawyer in the case, Ira Schwartz, argues in a brief filed earlier this month that the MP3 files Howell made on his computer from legally bought CDs are "unauthorized copies" of copyrighted recordings.

"I couldn't believe it when I read that," says Ray Beckerman, a New York lawyer who represents six clients who have been sued by the RIAA. "The basic principle in the law is that you have to distribute actual physical copies to be guilty of violating copyright. But recently, the industry has been going around saying that even a personal copy on your computer is a violation."

RIAA's hard-line position seems clear. Its Web site says: "If you make unauthorized copies of copyrighted music recordings, you're stealing. You're breaking the law and you could be held legally liable for thousands of dollars in damages."

Below is a copy of an email that I just sent to both US Senators from the State of Alabama....

It has been several years since I have felt moved enough over a subject to write you. The current state of affairs in the government, overall, is hopeless so I see no need of conversation. We, as Americans, will try again after the '08 elections. However, there is one thing that I feel to ask your help. My concern is the RIAA. The link below is to a Washington Post article and, if true, goes so far beyond what I feel is fair and legal that it shakes the foundations of liberty. I realize that is an idealistic statement but if you have any knowledge of the past few years and the lawsuits brought by the RIAA you can see the power of one entity imposing itself upon the populace as a whole, Please, if you will, try to see if something can be done to curb this dictatorial dinosaur known as the RIAA. Again, if the article is true, then the RIAA has passed the point of even being ridiculous. I thank you in advance for whatever help you can initiate. Here is the link...

Heh.. That's messed up.. Btw, how they found out that he has such a Big collection of "Illegally" copied Music ?


p.s. Ha ha ha.. they Fightin' a Ghost.. :) Instead of Suing the guys with Legal music, they should Sue (Damn it, how to write this Word Correctly ?) large WareZ portals.. but wait.. they can't do it, because usually all Warez portals holding their files on Free File upload hostings, and Maximum what they can do, is ask to delete those files, because Links is Not illegal ;), at least Yet.. :)

So again, they Fighting with a Ghost.. they fighting the Battle which they never Win :cheers:

David Byrne (Talking Heads, Solo stuff, all-around badass) wrote a great piece for Wired magazine in the January issue that you can read. This article seems to be the web-version but it's verbatim. He also conducted an interview with Thom Yorke about Radiohead's decision to release "In Rainbows" the way they did. Good reading.

Oh, and F the RIAA.
